Choosing Your JDG Tax Form in Poland: A Foreigner's Guide

Choosing Your JDG Tax Form in Poland: A Foreigner's Guide
Navigating the Polish tax system as an English-speaking entrepreneur running a JDG (jednoosobowa działalność gospodarcza, or sole proprietorship) can feel like a maze, especially when it comes to selecting your income tax form. The right choice is critical because it significantly impacts both your annual PIT (Personal Income Tax) and your ZUS health contributions. In Poland, you primarily have three options for your JDG: Skala Podatkowa (Progressive Scale), Podatek Liniowy (Flat Tax), and Ryczałt od Przychodów Ewidencjonowanych (Lump Sum Tax on Revenue). There's no single "best" option; what works for one business might not for another, so understanding each is key to optimizing your financial obligations. Let's break down these options. The Skala Podatkowa is a progressive tax scale, meaning your tax rate increases with your income. For most entrepreneurs, this means a 12% rate on income up to a certain threshold, and then 32% on income exceeding that amount. This form allows you to deduct business costs, social security contributions, and benefit from various reliefs like joint taxation with a spouse or child tax relief. Podatek Liniowy, on the other hand, offers a flat 19% tax rate, regardless of your income level. While it also allows for cost deductions, it generally restricts access to certain reliefs, such as joint taxation. Finally, Ryczałt od Przychodów Ewidencjonowanych is a simplified form where you pay a percentage directly from your revenue, not your profit. This means you cannot deduct business costs, making it most suitable for businesses with high revenue but very low operating expenses. The specific percentage for Ryczałt varies depending on your business activity. A common mistake foreigners make is not thoroughly evaluating their projected income and expenses before committing to a tax form, or failing to review their choice annually. Remember, your selection doesn't just affect your PIT; it also has a profound impact on how your ZUS health contribution is calculated. For instance, the health contribution under Ryczałt is often based on your revenue bracket, while under Skala or Podatek Liniowy, it’s typically linked to your income. It's essential to consider all these factors, alongside future obligations like adapting to the KSeF (National e-Invoicing System) for issuing and receiving invoices, to make an informed decision for your business in Poland. Choosing and managing the correct tax form, calculating ZUS contributions, handling PIT/VAT taxes, and navigating KSeF invoices can be time-consuming and complex. That’s where Rozlio comes in.
