Understanding Poland's Mandatory Split Payment (MPP) for Your Business
Running a business in Poland as a foreigner means navigating unique tax rules, and one crucial aspect is the Split Payment Mechanism, known as MPP (Mechanizm Podzielonej Płatności). This system is designed to enhance VAT collection security and is mandatory for specific transactions. If your VAT invoice for certain goods or services from Annex 15 of the Polish VAT Act (such as steel, electronics, or construction services) exceeds 15,000.00 PLN gross, using MPP isn't optional – it's a legal requirement.
So, what does this mean for your business (your JDG, for instance)? When MPP is applied, the payment is split into two parts. The net amount of the invoice goes to the seller's regular bank account, while the corresponding VAT amount is transferred to a dedicated VAT account belonging to the seller. Crucially, the funds in this VAT account are restricted; they cannot be freely spent by the seller for general business expenses. For you, as the buyer, ensuring you correctly apply MPP when obligated is vital. Failing to do so carries a significant risk: a penalty of 30% of the VAT amount on that invoice can be imposed, a costly mistake for any entrepreneur.
Identifying whether your transaction falls under Annex 15 goods or services is paramount. This list includes specific items and categories like certain types of steel products, electronics, and various construction services. Always verify if the items or services you are purchasing are on this list, especially when the invoice value approaches or exceeds the 15,000.00 PLN gross threshold. Misunderstanding or overlooking this requirement is a common pitfall for foreign entrepreneurs, leading to unexpected financial penalties and compliance issues with Polish tax authorities (Urząd Skarbowy). Proactive management of your VAT (Podatek od Towarów i Usług) obligations, including MPP, is key to smooth operations.
