Polish JDG Suspension: What Foreign Entrepreneurs Need to Know
Running a business in Poland as a foreigner brings unique challenges and opportunities, and sometimes you might need a temporary pause in your operations. Good news: if you operate a JDG (jednoosobowa działalność gospodarcza), which is a sole proprietorship, and do not employ staff, you have the flexibility to suspend your business activity for any duration. This period can range from a minimum of 30 days up to an indefinite period. Crucially, during this suspension, you are not required to pay advance payments for PIT (Personal Income Tax) or ZUS (Social Security) contributions, nor do you need to submit JPK_V7 declarations, offering significant financial relief.
The process to suspend your JDG is straightforward and free of charge, handled through the CEIDG (Centralna Ewidencja i Informacja o Działalności Gospodarczej) system. However, it’s vital to understand the strict limitations during a suspension period: you absolutely cannot conduct any ongoing business activities or issue new sales invoices. The only exceptions are activities related to obligations or rights that arose *before* the suspension, such as collecting receivables, settling prior debts, or fulfilling warranty obligations. This means no new client work or revenue generation is permitted while your JDG is suspended.
Failing to adhere to the "no ongoing business" rule during suspension can lead to serious legal and tax consequences. This mechanism is specifically designed for a genuine break, offering a valuable tool to manage periods of reduced activity, personal leave, or strategic re-evaluation without incurring the regular fixed costs of running a business, particularly the often substantial ZUS contributions. While you're relieved from filing JPK_V7 for VAT purposes, remember that you still need to maintain proper records and may need to deal with administrative tasks related to past operations.
